「禁止強迫佔領地區住居民，宣誓效忠敵對國」(公約附則第四十五條)的規定。尤其，未經台灣、澎湖人民的同意，強制實施中華民國法律，違反其在大西洋憲章聯合國宣言所作出的承諾及遵守戰爭公約的義務，竟然將一九四七年台灣人民壯烈自決行動，視為「叛亂」，不經審判，不給予summary judgement，一律格殺勿論，Summary Execution。無視自然權利的不可剝奪，違反戰爭公約、違反人道，造成二二八大屠殺。
依據戰爭公約規定，軍事佔領當局(Military Authority)，「禁止強迫被佔領地區住居民，宣誓效忠敵對國。」(It is forbidden to compel the Inhabitants of occupied territory to swear allegiance to the hostile state.)[Laws and Customs of War on Land (Hague, IV), 1907.10.18, “Hague Regulations”, Annex to the Convention Regulations respecting the Laws and Customs of War on Land, Section III, Military Authority over territory of hostile state, Article 45]
禁止強迫被佔領地區住居民，宣誓效忠敵對國。當然，禁止佔領當局、佔領國，將佔領地區人民、土地，納為其國民、國土，永遠效忠佔領國。
