「蓋此權力乃人民僅為其利益，而委託他人。然，發覺竟然用來侵害他們。」 

洛克揭示社會契約的理性。

人民為其利益，將權力委託政府，政府不得用此權力來侵害他們。

美國獨立宣言重申此理性。

故謂 :

「為了保障此等權利，人民成立政府，故而，政府的正當權力，係來自人民的同意。」

「That to secure these Rights, governments are instituted among men, deriving their just powers from the consent of governed. 」( Declaration of Independence, 1776.07.04 )

政府是手段，人民必須操控手段，始能達成其目的。

因此 :

「一旦任何型態的政府，變成此等目的的破壞者，人民即有權將其更換或廢除，進而建立新政府，依據上述原理奠定其政治體制基礎，並依此原理所規劃的形式，組織其權力架構，使得人民感受到具體改變其安全保障與幸福。」

「That Whenever any form of government becomes destructive to these ends. It is the right of the People to alter or abolish and to instutite new government, laying its foundation on such principles and organizing it powers in such form, as to them shall seem most likely to affect their safety and happiness. 」( Declaration of Independence, 1776.07.04 )

北美洲的大英帝國屬民宣布獨立建國，更據此社會契約理性，建立三權分立的權力制衡 ( check and balance ) 政治體制。

而美國聯邦憲法明文載入此社會契約理性，以節制權力與防止權力的濫用。

但還是未將同意原理的理性基礎，即人人完全自由與人人完全平等，

規定於憲法條文。

因此，存在已久的奴隸制度，並沒有廢除或宣告違憲。

林肯總統逝世、內戰結束當年（一八六五年）十一月，聯邦政府完成憲法第十三增修案的立法程序，禁止奴役。第十四、十五增修案亦於一八六八年、一八七Ｏ年完成立法，不分種族、膚色、信仰，皆平等享有生命、自由、財產權、平等法律待遇、選舉權。一九二Ｏ年，婦女選舉權列入憲法增修條文，自由平等，已無性別差異。

如是，美國人得以高枕無憂，安心築夢。
